Without prejudice.

(This document is a "without prejudice" document within the meaning given that term under common law (and relevant statute law) in the Commonwealth of Australia, the Dominion of Canada, any other common law jurisdiction that recognises the "without prejudice" doctrine, and also, in mitigation, any other jurisdiction whether or not recognises the "without prejudice" doctrine.)

It is my honest belief that "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart is not protected by copyright, as it was published more than fifty years from today, Tuesday Twelfth of March Two Thousand and Two; moreover, the text of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart is unavailable to most members of the public, as it is "out of print."

It was and is my intent to publish "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart on the "World Wide Web" or "internet", as defined under common law and/or statute law in the Commonwealth of Australia, the Dominion of Canada, or any other relevant jurisdiction, purely for study and/or critical purposes, as defined under common law and/or statute law of copyright of the Commonwealth of Australia, the Dominion of Canada, or any other relevant jurisdiction.

If, on advice (in advance of any legally binding order or judgement) from the executors of the estate of Elizabeth Smart and/or the copyright owners of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart, that reproduction of the text of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart, as I have reproduced it, may be protected by copyright beyond study and/or critical purposes, I promise and undertake to:
- delete that text of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart that is under my control from "the internet";
and
 - pass to the executors of the estate of Elizabeth Smart and/or the copyright owners of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart the electronic records, as "html files", of "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart.

Despite all of the above, it is my honest belief that "By Grand Central Station I Sat Down and Wept" by Elizabeth Smart is not protected by copyright.
